There are more than 100,000 cellar or basement apartments being rented illegally in the city, according to estimates by housing non-profit Chhaya CDC. Some are unsafe firetraps, but others simply don’t follow the city’s code, which requires half or more of an apartment to be above ground.


If the study finds that it makes sense to convert basement apartments, the city will use $12 million to support this in the neighborhood‘s approximately 1,800 single- and two-family homes. It‘s unclear how many of the homes already have “illegal“ tenants.

"The basement is really big and it's ample it's really nice me and my son love it here. We don't want to move anytime soon. It's less expensive than a one bedroom or two bedroom apartment, which I cannot afford right now," said Marcos of her apartment, which she has been renting for four years.
